Terms and Conditions

1. Delivery and Removal of Equipment

The hirer authorises ROSC to bring it’s vehicle onto his property to deliver and to recover the equipment at the end of hire. ROSC shall not be responsible to the hirer nor third parties for any damage that may be done to driveways or underground services by any reason of the weight of the vehicle. Requests for collection must be made by telephone when the hirer has finished with the equipment and not by prior assumption on quote dates. All cartage charges are included in the quoted price. Client is responsible for equipment until it is picked up from site by ROSC.

2. Hire Period

Hiring commences from the date of completed set up, and terminates at the time stated by the hirer via telephone. Equipment will be picked up shortly after this notification.

3. Hiring charges

In absence of any special agreements, equipment is hired for a fixed rate, allowing up to four weeks, which includes cartage both to and from the site. Weeks/Part weeks after the initial fixed rate will be charged at 10% the fixed rate per week/part week. Progress payments will be required monthly if the job continues over the allotted time.

4. Payment

a) Unless the hirer operates a credit account with ROSC, a deposit of 50% is required before hiring commences.

b) The hirer by signing and accepting the quote agrees to the terms and conditions as laid down by ROSC and agrees to pay any costs of collections and all legal fees incurred by ROSC in the event of legal action becoming necessary. We retain the right to come onto your property and remove the equipment if payment or progress payments are not made within the allotted time.

c) Damaged gear or loss of gear will occur appropriate charges to replace/repair equipment.

d) Where the hirer operates a credit account with ROSC, payment is due 20th of the following month after date of invoice. Where payment is not made ROSC reserves the right to charge default interest at the rate of 5% per month accruing.

5. Hirers Responsibilities

It is the hirer’s responsibility to satisfy himself that the equipment is suitable for the work intended. He also warrants that the people intending to use the equipment are competent and qualified to use the equipment in the way it is designed. The Hirer shall not have any claim over ROSC for loss or damage suffered by the hirer as a result of the hirers use of the equipment and further the hirer will indemnify ROSC against any claim by a third party in respect to loss, injury or liability arising from this hiring or arising from the use of the equipment hired by the hirer.

6. ROSC’s Responsibilities

ROSC will ensure that the equipment is erected in a manner which complies with all statutory requirements, by Ticketed professionals.
